The petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 346 of 2017 registered under Sections 272, 273/34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that only on the confessional statement of co-accused, petitioner has been made accused in this case. On perusal of seizure list, it appears that nothing has been recovered from the possession of petitioner. Petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

No.10065 of 2018 (2) dt.20-02-2018 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.II-cum-Special Judge, Excise Act, Sitamarhi in connection with Bathnaha P.S. Case No. 346 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
