The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406 and 420 of the Indian Penal Code.

As per FIR, In the Rajnish Consultancy, co-accused persons along with this petitioner cheated common people on the pretext of job. It is further alleged that they used to take money from the people in the name of giving job as well. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on suspicion. It is further submitted from para-14 of the petition that similarly

No.27076 of 2023(3) dt.24-07-2023 2/3 situated other co-accused persons, namely, Sanni@ Sanju Kumar, Saima Naaz, Beuty Kumari, Bittu Kumar, Pratima Kumari, Sanjay Ram and other have already been granted bail by learned lower Court vide order dated 21.12.2022 in B.P. No. 2335/2022, 2141/2022 and others. It is also submitted from para-15 of this petition that neither any aggrieved persons have come forward to support the prosecution case nor they have been examined or even their names have not been disclosed during the course of investigation. The petitioner himself was cheated in the name of job and nothing has been recovered from his conscious possession. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 05.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail.
