JUSTICE RAKESH KUMAR ORAL ORDER 13-01-2016 Heard Sri Purushottam Kumar Jha, learned counsel for the petitioner and Sri Girijesh Kumar, learned counsel, who has appeared on behalf of Opp.Party/ Bihar School Examination Board.

The present petition has been filed with a prayer to restore C.W.J.C.No. 7304 of 2007, which stood dismissed on 10.07.2015 due to non-prosecution.

In the present petition, the petitioner has brought on record photo copy of the daily cause list dated 10th July,2015 to show that in the daily cause list, the name of Sri Purushottam Kumar Jha, learned counsel, had not appeared from the side of the petitioner and, as such, it was bona fide reason for non-appearance After hearing and considering the ground set forth in the petition, same is allowed.

Patna High Court MJC No.3026 of 2015 (2) dt.13-01-2016 2/2 Let C.W.J.C.No.7304 of 2007 be restored to its original file.

Since on earlier occasion, the name of Sri Purushottam Kumar Jha had not appeared in the daily cause list, office is directed to incorporate the name of learned counsel for the petitioner in the daily cause list.
