JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 Earlier the prayer for bail of the petitioner was dismissed twice one vide order dated 09.10.2017 passed in Cr. Misc. No. 42068 of 2017 and vide order dated 19.09.2018 passed in Cr. Misc. No. 57906 of 2018 allegation against the petitioner is of running the flesh trade.

Submission of learned counsel for the petitioner is that he has been in judicial custody since 23.06.2017 and uptil now not a single witness has been examined and on merit also, the petitioner has been implicated in this case with allegation that he used to entice the minor girl but there is no statement of minor girl to prove the said allegation.

Heard learned A.P.P. and perused the report, from which, it appears that in spite of issuance of non - bailable

Patna High Court CR. MISC. No.23418 of 2019(3) dt.27-06-2019 2/2 warrants no witness has turned till 07.05.2019. Having heard both sides, considering the facts and circumstances of the case and also the period of incarceration of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge, Danapur, Patna, in connection with Rupaspur P.S. Case No. 03 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
