2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 379, 411, 413, 414 and 34 of the Indian Penal Code.

3. As per prosecution case, on the alleged date of incidence, a raid was conducted in the garage of this petitioner and 8 stolen motorcycles of different companies were recovered.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is owner of the garage in question and the motorcycles which were seized from the garage of the petitioner belongs to different customers and none of the motorcycles were stolen. Rather, they were kept in the garage for repair and merely on suspicion, this false and

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the rival submissions, nature of accusation and the fact that petitioner has got no criminal antecedents of similar nature, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia, in connection with K. Nagar (Sri Nagar O.P.) P.S. Case No. 728 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
