Petitioner being the brother of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 406 and 494 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of torture for non-fulfillment of dowry demand. It is alleged against the husband of the informant that he performed second marriage with one Priyanka, daughter of Pramod Manjhi.

It is submitted by learned counsel for the petitioner that the general and omnibus accusation has been levelled against

No.30892 of 2016 (2) dt.25-07-2016 2/2 the entire in-laws family including the petitioner since the husband of the informant filed Matrimonial Suit No. 124 of 2015 with a prayer of divorce at earlier point of time and, thereafter, the present F.I.R. has been registered. Moreover, the thrust of accusation is against the husband of the informant and the petitioner claims to be separate from the husband of the informant.

Considering the above facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Siwan in connection with Siwan Mahila Police Station Case No. 37 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
