2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 304(B), 120(B) and 201 of the Indian Penal Code.
3. The case of the prosecution is that the daughter of the informant was married to the petitioner and it is alleged that the petitioner and his family members (i.e in-laws of the informant's daughter) subjected her to cruelty on account of non-fulfillment of dowry demand and ultimately, she was killed. Hence, the present FIR.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.28005 of 2024(10) dt.02-04-2025 2/3 petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the trial of this case has proceeded and the informant herself, husband of the informant and son of the informant has given their deposition before the trial Court that the in-laws of the deceased have not subjected the deceased to cruelty on account of non-fulfillment of dowry. They have also stated that after the death of the deceased the informant and her family members have also participated in the cremation. It is further submitted that the parties have compromised the matter. This statement got substantiated from the deposition which brings through supplementary affidavit. Moreover, the petitioner is languishing in judicial custody since 15.07.2023 having no criminal antecedent.
5. Learned APP appearing for the Informant is also present and he has got no objection about the submissions put forward by the learned counsel for the petitioner.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bangaon P.S. Case No. 81 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two
