====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 30-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Kudhani P. S. Case No.604 of 2020, instituted for the offences under Sections 413, 414/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 14.09.2020 and chargesheet has been submitted in this case. The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that during course

No.33872 of 2021(2) dt.30-11-2021 2/3 of patrolling the police force when reached at Chhajan Gonu Chowk and started checking vehicle, he saw that a person on Bajaj Discover motorcycle after seeing the police started fleeing away, but was caught after chase along with two persons, who were sitting along with the motorcycle. It is further alleged that the motorcycle was searched, but nothing was recovered, but they could not show any document relating to the motorcycle and told that the motorcycle is stolen one.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and motorcycle has not been recovered from his possession. He was merely standing on the road when the police chased and arrested the other accused persons.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 14.09.2020 and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two
