2. The petitioner has approached this Court for the following reliefs:- "1. That this is an application issuance of an appropriate writ, order or orders directing on a writ in the nature of mandamus directing the respondent no. 3 and 4 in PB (6600 & 7600) to make payment of 2nd and 3rd ACP in MACP Scheme 2010 vide memo no.1071 dated 07.10.2021 and letter No.1064 dated 14.09.2022 to the petitioners further directing the respondents to make payment in grade pay of PB3 PB (6600 &

Patna High Court CWJC No.7359 of 2025(3) dt.09-10-2025 2/3 7600) with interest and any other appropriate reliefs to the petitioners for which payable may found under fact and circumstance."

Learned Advocate for the petitioner submitted that the issue with regard to the grant of extending the benefit of ACP/MACP came to be settled by a full Bench of this Court in the case of Kamala Nand Thakur vs. The State of Bihar & Ors., C.W.J.C. No. 18727 of 2017. Despite the aforesaid position, the grievance of the petitioner has not been redressed, though the petitioner has filed a detailed representation for redressal of his grievance, the copy of which is marked as Annexure P/5.

In view of the submissions advanced, the present writ petition stands disposed off with a direction to the District Programme Officer (Establishment) Khagaria to consider the claim of the petitioner in the light of the decisions rendered by the Full Bench of this Court and bring to its logical conclusion, preferably within a period of twelve weeks from the date of receipt/production of a copy of this order.

5. Suffice it to observe that in case the claim of the petitioner finds favour, necessary consequential order must be passed within the period stipulated.
