JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Complaint Case No. 1879 of 2014 registered for the offence punishable under sections 498A of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner is not the husband of the complainant. She was first married with one Ajay Singh @ Dilkhush and her second marriage was solemnized with Samar Singh, which is evident from Voter Id Card, residential certificate, passbook etc. annexed as Annexure-3 series to this application. As a matter of fact, mother of the petitioner had lodged a case against the complainant, and only in order to save skin, the present false
Patna High Court Cr.Misc. No.32047 of 2017(4) dt.14-09-2017 2/2 case has been lodged with intention to grab his properties. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IX, Bhagalpur in connection with Complaint Case No. 1879 of 2014 subject to the conditions laid down under section 438(2) Cr.P.C.
