JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-09-2019 Perused the report of learned Additional District and Sessions Judge-II-cum-Spl. Judge, Excise, Samastipur. The petitioner apprehends his arrest in connection with Excise Case No. 56 of 2007 registered under Section 47A of the Excise Act with respect to recovery of 73.5 litres illicit country made liquor on 30.08.2006 from the house of the petitioner. From the report, it appears that process under Section 82 Cr.P.C. has already been issued against the petitioner and petitioner has preferred the present bail application after about 12 years, as such I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
