JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Adapur (Harpur) P.S. Case No. 04 of 2023, registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act. The impugned order shows itself that the Medical Board has assessed the age of the victim as 20 years and in her statement recorded under Section 164 of the CrPC she has stated that she has solemnized her marriage with co-accused Sonu

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge POCSO Act, East Champaran at Motihari in connection with Adapur (Harpur) P.S. Case No. 04 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
