JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-08-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Matihani P.S. Case No. 23 of 2017, registered for the offences punishable under Sections 447, 341, 323, 326, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegedly, the petitioner and co-accused Mukesh Singh started demanding dues money from the informant and when the informant replied that within seven days he will pay the money, then the petitioner started abusing and on protest coaccused Mukesh Singh took out his pistol from his waist and fired upon him which hit the hand of the informant and caused injury

Patna High Court Cr.Misc. No.32345 of 2017 (3) dt.21-08-2017 2/2 and when Mamta Devi came for his rescue, she was assaulted by Mukesh Singh.

Submission is of false implication and that against the petitioner there is no allegation for making assault to any one. The only allegation is for abusing the informant. The informant is a man of criminal nature and, as such, the petitioner who has got no criminal antecedent deserves sympathetic consideration. The learned A.P.P. fairly submits that against the petitioner there is only allegation for abusing. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Begusarai in connection with Matihani P.S. Case No. 23 of 2017, subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
