Despite valid service of notice, nobody appears on behalf of the State.

The petitioner seeks pre-arrest bail in connection with Chainpur P. S. Case No. 149 of 2016 registered under Sections 409 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the petitioner has handed over the folder file to the authority long back and a false allegation has been levelled against him that despite repeated directions, he has not handed over the charge of folder file of appointment of teachers of panchayat to the authority. He submitted that the petitioner is in government

Patna High Court Cr.Misc. No.21023 of 2017 (2) dt.06-07-2017 2/2 service and he is not likely to flee from justice. It is also contended that similarly situated co-accused have been granted anticipatory bail by this Court Considering the submissions made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Kaimur at Bhabua in Chainpur P. S. Case No. 149 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
