ANJANA MISHRA ORAL ORDER 19-12-2016 Heard Mr. Manish Rai Sharma, who is appearing under the instruction of Mr. (Dr.) Amrendra Kumar, learned counsel for the petitioners. Learned counsel for the State is present. The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/341/323/307/379/384 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have been named in a case of mob fury which took place after a truck met with an accident, killing a child. It is submitted that certain members of the public assembled, attacked the driver and Khalasi of the vehicle which had caused the said incident, as a result of which, the present case has been lodged against the members of the mob in the road fury case. Patna High Court Cr.Misc. No.32403 of 2016 (2) dt.19-12-2016 P2/2 submitted that these petitioners have no specific role to play and have been named only as members of the mob.
In view of the aforementioned facts and circumstances and there being no specific allegation and that they are having clean antecedent, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S. Case No. 22 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
