In this case, the petitioner is seeking anticipatory bail in connection with Gardanibagh P.S. Case No. 500 of 2018 registered for offence punishable under sections 419, 468, 471, 472 and 120B of the Indian Penal Code.

Allegation has been made that the time of written examination, the petitioner hired a scholar and in his place, scholar appeared in the examination.

The learned counsel for the petitioner submits that every stage, proper identification was made and allegation made by the authorities is illegal.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and

Patna High Court CR. MISC. No.28637 of 2019(2) dt.01-05-2019 2/2 accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail before the court below within a period of three weeks from today, the court below, preferably on the same day, will take decision in accordance with law and also examine as to whether the allegation made against this petitioner is substantiated by any material or it is mere a suspicion.
