The petitioner seeks pre-arrest bail in connection with Sursand P.S. Case no. 26/16 registered under sections 341, 323, 354, 307, 379, 504/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in this case due to annoyance, grudge and dirty village politics. The informant belongs to the same family and some altercation had taken place between the family members as a result of which the petitioner, who is a man aged more than 60 years, has been implicated in this case. Further contention is that all other coaccused persons have already been granted pre-arrest bail by the

Patna High Court Cr.Misc. No.29007 of 2016 (2) dt.26-07-2016 learned Sessions Judge, Sitamarhi vide the impugned order dated 28.03.2016.

Regard being had to the submissions advanced at the Bar and the nature of allegation made in the first information report, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Pupri at Sitamarhi subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
