Petitioner seeks bail in Bihta PR P.S. Case No. 199 of 2019 and Special Case No. 2448 of 2019 registered under Section 30(a) of the Prohibition and Excise Act. The accusation is of recovery of 15 litres of country made liquor kept in a plastic jerkin from the field behind the house of the petitioner.

Learned counsel for the petitioner submits that the field from which the alleged country made liquor is said to have been recovered does not belong to the petitioner rather the same belonged to Shambhu Rai. The petitioner having no criminal antecedent is in custody since 07.03.2019.

Having regard to the facts and circumstances of the

No.23293 of 2019(2) dt.11-04-2019 2/2 case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of Special Judge, Excise Act, Patna in Bihta PR P.S. Case No. 199 of 2019, Special Case No. 2448 of 2019.
