The petitioner is in judicial custody in connection with Jadiya P.S. Case No. 261 of 2021 for the offences under Sections 461, 379 and 411 of the Indian Penal Code. As per the FIR, the informant who is the owner of "New Gayatri Jewellers", Jadiya alleged that on 08.12.2021, when he opened his shop, he found the goods scattered and jewelleries (7 K.G. silver and 45 Grams golden) were stolen. Accordingly, the FIR was lodged.

Learned counsel for the petitioner submits that he is

Patna High Court CR. MISC. No.25123 of 2022(3) dt.21-09-2022 2/2 innocent and his name has come up on the confessional statement of Mohan Mandal. He further submits that although the police has shown recovery from his side, in view of the fact that those have not been put on T.I. Parade, it cannot be assumed that the same belongs to the stolen articles. It is his last submission that petitioner is in custody since 15.01.2022 and he has no criminal antecedent.

Learned APP for the State, on the other hand, submits that there is clear complicity of the petitioner herein and as such he does not deserve bail.

Considering the aforesaid facts and circumstances of the case, this Court for the present is not inclined to grant any relief to the petitioner herein which is accordingly rejected. (Rajiv Roy, J) Jagdish/NehaU T
