JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-02-2021 Heard Mr. Jugal Kishore, learned counsel for the petitioner, Mr. Akshaylal Pandit for the State and Mr. Radha Mohan Singh, learned counsel for the Informant. Petitioner apprehends his arrest in connection with Saraiya PS Case No. 799/2019 registered for the offences punishable under Sections 498/34 of the IPC.
The allegation, as per FIR, is that the marriage of the informant was solemnized with the petitioner on 24.11.2019. It is further alleged that on 25.11.2019, the family members of the petitioner reached there and refused to perform Bidai till the demand of Rs. 15 Lacs is not fulfilled. It is also alleged that the
Patna High Court CR. MISC. No.24277 of 2020(6) dt.18-02-2021 2/2 petitioner also demanded dowry from the informant and refused to perform Bidai.
Learned counsel for the informant, referring to the final form, submits that after investigation, police exonerated the petitioner and others and did not send the petitioner for trial and charge-sheet bearing Charge No. 330/2020 has been submitted only against the elder brother of the petitioner, namely, Abhishek Kuer.
As such, the petitioner has got no apprehension of arrest at this stage.
Learned counsel for the petitioner, in the aforesaid circumstances, seeks permission to withdraw this application for anticipatory bail with a liberty to approach this Court as and when required.
Permission is accorded.
