====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Nathnagar P.S. Case No.759 of 2018 registered under Sections 25(1-b)a and 26 of the Arms Act.

The accusation is that on receiving secret information about the gathering of the miscreants, the informant along with police officials reached near Sukhraj Rai High School, then on seeing the police vehicle, some persons started to flee away. While the police party tried to apprehend them but they succeeded to flee away. From the spot, one Hero Honda motorcycle of red colour without number plate was recovered and on search of the motorcycle, one loaded country made pistol

Patna High Court CR. MISC. No.23370 of 2019(2) dt.11-04-2019 2/2 was recovered. The villagers disclosed that the said motorcycle is of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case at the instance of his enemy and is in custody since 24.12.2018. On investigation, the charge-sheet has already been submitted by the police against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bhagalpur, in connection with Nathnagar P.S. Case No.759 of 2018.
