Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Jogbani P.S. Case No. 187 of 2019 corresponding to Sessions Trial No. 20 of 2020, registered for the offence punishable under Sections 365, 371 of the Indian Penal Code.

As per the prosecution case, this petitioner was arrested along with a minor child and it is alleged that this petitioner was going to sell that child in Nepal. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and he is in custody since 30.06.2019 having no criminal antecedent.

Patna High Court CR. MISC. No.34768 of 2021(3) dt.14-09-2021 2/2 Chargesheet has already been submitted.

Learned APP however, vehemently opposed the prayer for bail and submitted that petitioner is habitual offender and indulged in selling of minor child in Nepal. Considering the nature of allegation and gravity of offence, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
