The petitioners, who are father and sons, apprehend arrest in relation to a case registered for the offence punishable under sections 341, 323, 504, 379, 386, 354(B)/506 of the Indian Penal Code.
Learned counsel for the petitioners states that the property in question belongs to Radhey Krishna Trust of which the informant used to be Shebait but has been removed in the year 2008 itself. Therefore, to say that the informant had come to collect rent from the petitioners as they were her tenant is false. This story has just malafidely been made to get the petitioners
Patna High Court Cr.Misc. No.31331 of 2016 (3) dt.06-10-2016 vacated from the premises in question.
Be that as it may, the petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur District Madhubani in connection with Madhepur P.S. Case No. 25 of 2015, G.R. No. 519 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
