3. 27.05.2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The learned counsel for the petitioner Shri. Arup Kumar Chongdar and the learned counsel for the respondent Bihar Staff Selection Commission, Shri. Anjani Kumar Mishra are in agreement that the present case is squarely covered by a judgment dated 03.03.2021 rendered by a coordinate Bench of this Court in CWJC No. 6761 of 2020 (Sudisht Kumar Mahato vs. State of Bihar & Ors.) and other analogus cases.

The learned counsel for the parties have further submitted that by the aforesaid Judgment rendered in the case of Sudisht Kumar Mahato (Supra), the merit list in question, prepared for the purposes of making appointment on the post of Lab Technician in the Health Department, Government of Bihar, has been quashed and the respondent Commission has been directed to prepare a fresh select list after considering the case of the writ petitioners of the said case and in accordance with the observations made in the said Judgment, hence similar treatment is required to be extended to the petitioners. Accordingly, the present writ petition stands disposed off, with consent of the parties, in terms of the judgment dated 03.03.2021 passed in the case of Sudisht Kumar Mahato (supra).
