The petitioners apprehend arrest in a case registered for the offences punishable under sections 409, 420 and 386/34 of the Indian Penal Code.

Patna High Court Cr.Misc. No.50344 of 2015 (3) dt.14-12-2015 Petitioners Jitendra Narayan Singh and Sumer Kumar Singh are Inspector and Sub Inspector under the Prevention of Cruelty to Animal Act. The police raided the place. They arrested three persons, namely, Madan Singh, Bijli Singh and Naushad Khan. They are said to have disclosed that petitioners Jitendra Narayan Singh and Sumer Kumar Singh have authorized them to collect money from the owners of truck carrying cattle.

It is submitted that nothing has been recovered from possession of the petitioners. There is no paper to show that the petitioners authorized the apprehended accused to collect money. Petitioner Ajit Kumar Singh is the owner of Bolero vehicle bearing registration no. BR 45P-1075. It is submitted that the vehicle was hired and there is nothing on the record to show that the petitioners were, in any way, involved in collecting illegal money.

Considering the facts aforesaid, the three petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial
