JUSTICE SHIVAJI PANDEY ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and learned counsel for the Power Holding Company. In this case, the petitioner is seeking anticipatory bail in connection with Beur P.S. Case No.75 of 2016, registered for the offence punishable under Section 135 of the Electricity Act.

A raid was conducted in the shop of the petitioner and it was found that the petitioner has damaged the meter Board and was committing theft of electrical energy, which has been calculated to the tune of Rs.1,07,550/-. Looking to the nature of allegation and the facts

Patna High Court Cr.Misc. No.28715 of 2016 (5) dt.01-09-2016 2/2 and circumstances of the case, let the petitioner-Sanjay Saran Singh @ Sanjay Singh in the event of arrest or surrender within four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Special Judge, P.E.S.U. Area, Patna, in connection with Beur P.S. Case No.75 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also on condition that petitioner would deposit an amount of Rs.35,000/- (Rupees Thirty Five Thousand only) in the Electricity Board within a period of one week from today. If the petitioner fails to deposit the aforesaid amount in the Electricity Board within the stipulated period, then this order will be treated to have been withdrawn. It is made clear that the aforesaid amount will be subject to final result of the proceeding before the competent authority assessed by the Authority under the Act.
