The petitioner apprehends his arrest in Pipra P.S. Case No.174 of 2017 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The police saw one vehicle passing through and suspected that some suspicious material was kept in the vehicle. On such, the police chased the vehicle and saw that some persons unloaded some articles. On chase, Jogi Sharma was apprehended but the driver of the vehicle managed to flee away. Jogi Sharma disclosed that driver of the vehicle had asked him to keep the country made nepali liquor.

The learned counsel for the petitioner submits that petitioner is owner of the vehicle and only because the petitioner

Patna High Court CR. MISC. No.23556 of 2019(2) dt.11-04-2019 2/2 happens to be owner of the vehicle, he has been made accused in the case. The driver of the vehicle was plying the vehicle on hire. Petitioner had no knowledge that driver of the vehicle was carrying illicit liquor in his vehicle. Petitioner has got no criminal antecedent.

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge 2nd -cum-Special Judge, Excise, Supaul in connection with Pipra P.S. Case No.174 of 2017(S.T.
