The petitioner apprehends his arrest in Bhagwanpur P.S. Case No. 159 of 2020, registered for the offence punishable under Section 414 of the Indian Penal Code and sections 20, 22, 24, 27, 27A and 29 of the Narcotic Drugs and Psychotropic Substances Act.

As per the prosecution case, on secret information that Ganja is being carried by Maruti Swift Dzire Car a raid was conducted. On seeing the police party all the accused persons fled away leaving the said vehicle and upon search, from the dickey of said vehicle 2.3 KG of Ganja has been recovered. It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner

Patna High Court CR. MISC. No.34946 of 2021(3) dt.23-06-2022 2/2 and he has been made accused in this case only on suspicion. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the alleged recovery. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 159 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
