JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Goh P.S. Case No. 232 of 2018, registered for the offences punishable under Sections 341, 323, 307, 337, 338 and 504 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is of assaulting the informant by bricks and there is specific allegation against one co-accused Uma Shankar Yadav of assault.

Submission of learned counsel for the petitioner is that there is case and counter case between the parties and no specific allegation has been attributed against him. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court CR. MISC. No.22674 of 2019(2) dt.09-04-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Daudnagar, Aurangabad, in connection with Goh P.S.Case No. 232 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
