1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

3. The informant alleges that on 20.12.2021, five unknown motorcycle borne criminals came variously armed and looted the petrol pump of the informant along with Rs. 27,500/- from his sale.

4. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that petitioner is an employee of L&T Company as would be evident from

No.25021 of 2023(2) dt.20-07-2023 2/2 Annexure-2 to the anticipatory bail application and he came to be implicated in the confessional statement of Abhishek Kumar Ojha in police custody which does not have any evidentiary value. It is next submitted that being an employee of a reputed company, why the petitioner would have indulged in such an occurrence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Motihari Muffasil P.S. Case No. 673 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
