The petitioner apprehends his arrest in Chhabilapur P.S. Case No. 27/2016, registered for the offences punishable under Sections 308, 325, 323 and 341 of the Indian Penal Code. The informant alleged that the petitioner was driving Jharjharia vehicle (motor fitted with Thela), negligently dashed the brother of the informant.

Learned counsel for the petitioner submits that there is no injury report of the brother of the informant. The brother of the informant dashed vehicle of the petitioner and got injured. It appears that there is specific allegation that the petitioner was driving unregistered Jharjharia vehicle rashly and

Patna High Court Cr.Misc. No.30287 of 2016 (2) dt.14-09-2016 2/2 dashed the brother of the informant causing fracture. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
