The petitioner is apprehending his arrest in connection with Khirhar P.S. Case No. 34 of 2013 for the offences instituted under Sections 302 and 201 of the Indian Penal Code. As per prosecution case that the informant has given his statement before the Officer Incharge regarding the death of deceased Girja Devi. The statement was lodged that one dead body who was floating in Thumhan river having the age about 50 to 55 years.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Informant is the daughter of the deceased. She has very categorically stated that her
Patna High Court Cr.Misc. No.50605 of 2015 (4) dt.17-03-2016 mother had lost her mental balance and she got drown in the river. Petitioner is not named in the FIR. Subsequently, in course of investigation, a suspicion has been raised against the petitioner. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the implication of the petitioner.
On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Khirhar P.S. Case No. 34 of 2013 (G.R.No.1596 of 2013) on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Madhubani, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
