JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-09-2015 The petitioner, a licensee of whole sale kerosene oil dealer being license no.22 of 1985, prays for quashing order dated 10.6.2013, passed by respondent no.2 cancelling his license.

The petitioner states that the show cause dated 12.5.2013 is defective as it states that if the reply is not satisfactory, the license would be cancelled and it will appear from the enquiry report that the petitioner has distributed the K.oil to the PDS dealers. Further, there is no allegation from the PDS dealers that they were not supplied the commodity. As the petitioner has alternative remedy, the writ petition is disposed of with liberty to the petitioner to take resort to the alternative remedy.

In case, petition for condonation of delay is filed, the same would be considered sympathetically, as the petitioner

Patna High Court CWJC No.13514 of 2013 (2) dt.03-09-2015 2/2 was pursuing the remedy before this Court.
