JUSTICE RAKESH KUMAR ORAL ORDER 12-02-2018 Heard Shri Manoj Kumar, learned counsel for the petitioners and learned Additional Public Prosecutor. Three petitioners, apprehending their arrest in Parasbigha P.S. Case No. 181 of 2017 registered for the offence under Sections 448, 341, 323, 325, 307, 379, 506/34 of the Indian Penal Code , 1860 have prayed for grant of bail in the event of their arrest or surrender.

Learned counsel for the petitioners by way of referring to the FIR i.e. Annexure - '1' submits that from the FIR itself it is evident that the dispute was in relation to land in between own family members. He further submits that in the occurrence the informant's side of the present case were aggressors and from

Patna High Court Cr.Misc. No.6741 of 2018(2) dt.12-02-2018 2/2 petitioners' side also petitioner no. 1 had lodged an FIR against the informant's side of the present case. Besides this, it has been argued that there is no specific serious accusation against either of the petitioners.

Considering the facts and circumstances particularly the fact that there was case and counter case in between own family members, in the event of arrest or surrender within a period of six weeks from today, let the aforesaid three petitioners Sonu Kumar, Vikash Kumar and Sumitri Devi be enlarged on bail on furnishing bail bonds of Rs. 10,000/- ( rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad/ concerned court in connection with Parasbigha P.S. Case No. 181 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J) praful/- U T
