JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Bhagwan Bazar P. S. Case No. 25 of 2017 registered under Sections 147, 341, 323, 324, 307, 504, 354-B, 114 of the Indian Penal Code.
It is contended that petitioner no. 1 Tripurari Prasad and petitioner no. 2 Ashwani Kumar are alleged to have caught hold of members of prosecution party. It is further stated

No.21080 of 2017 (2) dt.06-07-2017 2/3 that so far as petitioner no. 3 Dhiraj Kumar is concerned, there is allegation against him that he assaulted with knife to Soni Devi over her chin. The injury report would show that she had sustained lacerated would on chin which was simple in nature. It is stated that there is case and counter and several members from the petitioners' side were also injured in the alleged incident. It is further stated that co-accused Jag Mohan Sah, Manit @ Munna, Sanjiv @ Baguri and Ujjawal Kumar @ Raja have been granted anticipatory bail by different Benches of this Court vide order dated 01.06.2017 and 15.06.2017 passed in Cr. Misc. No. 20104 of 2017 and Cr. Misc. No. 23576 of 2017. Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners.
However, he concedes that similarly situated co-accused have been granted privilege of anticipatory bail by this Court. Considering the submissions made above, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in Bhagwan Bazar P. S. Case No.
Patna High Court Cr.Misc. No.21080 of 2017 (2) dt.06-07-2017 3/3 Procedure, in the event of arrest or surrender before the court below within six weeks from today.
