The petitioner seeks bail in anticipation of his arrest in connection with Sarai P.S. Case No. 411 of 2019, dated 29.11.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The name of the petitioner has transpired only in the confession of an arrested accused person.
Notwithstanding the aforesaid fact, I am not inclined to grant bail to the petitioner for the reason that he is an accused in two other cases of similar nature.
The prayer for grant of anticipatory bail is, accordingly, rejected.
However, if the petitioner surrenders before the Court below, if he has already not surrendered and prays for bail, the Court below shall consider the case of the petitioner on its own merits without being prejudiced by the fact that the present petition has not been entertained by this Court.
