ANJANA MISHRA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kotwali P.S. Case No.238 of 2017 for allegedly having committed the offence under Sections 414, 467 and 468/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that on pure suspicion, the petitioner's name has been brought in connection with the present case. The vehicle in question was seized in an abandoned condition. It is submitted that the petitioner was arrested in connection with another case (Kotwali P.S. Case No.135/17) from the same place of occurrence and he has been granted bail in connection with the
Patna High Court Cr.Misc. No.35624 of 2017 (2) dt.10-08-2017 2/2 said case by the court below itself.
In view of the fact that the petitioner's name has surfaced on mere suspicion, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No.238 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
