JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with C.R. Case No. 1057 of 2013 (T.R. No. 3256 of 2018) lodged for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.
Allegation against the petitioner is that on the pretext of making visa and other documents he has taken Rs.45,000/- from the complainant and also collected altogether Rs.5.4 lacs and thereafter he fled away and has not sent the visa. Submission of learned counsel for the petitioner is that there is no document with respect to payment of those amount and also names of the persons from whom he has collected Rs.45,000/- each have not been mentioned in the
Patna High Court CR. MISC. No.23365 of 2019(4) dt.21-06-2019 2/2 complaint petition and he has falsely been implicated in this case.
Heard learned APP and learned counsel for the complainant, who has stated that he has given Rs.45,000/- on the assurance of making visa but petitioner has not supplied any document.
In view of above facts and circumstances, the provisional bail granted to the petitioner vide order dated 15.4.2019 is confirmed on the condition that petitioner shall deposit Rs.25,000/- before the court below, which will be subject to the result of the case and further petitioner has to cooperate in disposal of the case and appear before the court as and when required, otherwise bail bonds of the petitioner shall be cancelled.
