The petitioner is in custody in a case registered for the offence punishable under Sections 411, 413 and 414/34 of the Indian Penal Code.

As per allegation in the FIR, it is a case of theft of a mobiles of the informant.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits one smart phone was recovered from the conscious possession of the petitioner but no claimant of the said recovered mobile as submitted by learned counsel for the petitioner. Petitioner is in custody since 12.02.2024.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be directed to be released on bail after framing of the charge in connection with Kangali P.S. Case No.04 of 2024 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Pandit, Judicial Magistrate, Bettiah, West Champaran/concerned Court.

The trial court is directed to conclude the proceeding of framing of charge according to law within a period of 15 (fifteen) days from the date of receipt of a copy of this order. However, it is made clear that if the charge-sheet has not been submitted then the above named petitioners shall be released on bail on furnishing bail bond with further condition that the petitioner has to be present physically on each and every date before the Trial Court till conclusion of the trial.
