The Petitioner seeks quashing of the order dated 11.7.2011 by which the A.D.J., F.T.C. III, Gopalganj, has rejected the application filed under Section 228 Cr. P.C. in Sessions Trial No.471 of 2010.

Considering that even if charge under Section 307 Indian Penal Code is framed, no prejudice would be caused to the Petitioner and the charge can be amended at any stage of Trial, I am not inclined to interfere in the matter.

The application stands dismissed.

The Trial Court is directed to conclude the Trial expeditiously without granting unnecessary adjournment to any

Patna High Court Cr.Misc. No.26829 of 2011 (4) dt.09-03-2015 2/2 Party for which reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with Sessions Trial No. 474 of 2010 arising out of Mirganj P.S. Case No. 44 of 2010, to the Superintendent of Police, Goapalganj, and the Superintendent of Police, Gopalganj, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
