The petitioner seeks pre-arrest bail in connection with Jaynagar P. S. Case No. 290 of 2016 registered under Sections 406 and 420 of the Indian Penal Code and Section 7 of Essential Commodities Act.

In view of nature of allegation that several irregularities were found in the godown of PACS of which the petitioner was the Chairman and shortage and excess of foodgrains which were supplied to the PACS for distribution of BPL card holder under Antyayodya Scheme, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, his prayer

Patna High Court Cr.Misc. No.21009 of 2017 (2) dt.06-07-2017 2/2 for grant of pre-arrest bail is rejected.

However, in case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order. (Ashwani Kumar Singh, J.) Kanchan/- U T
