This is a compromise application filed by both the parties signed by them. The learned counsels for the parties submitted that this first appeal arises out of partition suit and because of intervention of the well-wishers of the parties, the parties have compromised and resolved their dispute and a compromise application being I.A. No.1289 of 2015 has been filed wherein at paragraph 3 the terms and conditions have been mentioned.
Perused the compromise application.
It appears that the same has been signed by the parties and affidavited by the parties also. There is no difficulty in
Patna High Court FA No.41 of 2011 (20) dt.27-02-2015 recording the compromise between the parties. In view of the above facts that the parties have compromised and a compromise application has been filed, this first appeal is disposed of in terms of the compromise application. The compromise application, i.e. I.A. No.1289 of 2015 shall form part of the decree.
