The petitioner seeks bail in connection with S.T. No. 40/2024, arising out of Bangaon P.S. Case No. 100 of 2023, registered for the offence under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act. Later on section 302 of the Indian Penal Code was also added.

As per the prosecution case, the named criminals and some unknown criminals went to the house of the deceased and dragged Md. Mister from the first floor and they started beating him. When the brother of the informant's husband Md. Sulo came to save him, a shot fired by the Suman Yadav which hit the deceased Md. Suo he was injured. During

No.29389 of 2024(3) dt.31-07-2024 2/2 investigation, witnesses have stated that the petitioner was one of the accused who had gone in the first floor along with other criminals and dragged Md. Mister and assaulted him. It has also come during investigation that the petitioner and others were hired to kill Md. Mister but Md. Sulo was killed. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. He further submits that petitioner has been made accused on the basis of suspicion. The petitioner has three criminal antecedents and he is in jail since 16.10.2023. 5.

Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail by contending that petitioner was also involved in the killing of deceased Md. Sulo. 6.

Considering the aforesaid facts and the serious allegation against the petitioner, this Court is not inclined to grant bail to the petitioner.

Accordingly, the application of the petitioner for grant of regular bail is dismissed.
