2. The petitioner seeks bail in connection with Hasanpur P.S. Case No. 135 of 2024 instituted for the offences punishable under Sections 115(2), 118(1), 117(2), 126(2), 109, 303(2), 3(5) of the BNSS.
3. As per the prosecution case, all the accused persons including the petitioner assaulted the informant with Farsa, Khanti, Varchhi, Vegetable cutter, lathi and iron rod on informnt's head causing head and hand injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that there is case
Patna High Court CR. MISC. No.28252 of 2025(2) dt.07-05-2025 2/3 and counter case due to land dispute attributed between the parties. He further submits that both sides have got injury. He next submits that the father of the petitioner lodged a complaint against the informant and his family members. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 23.02. 2025. He further submits that one of the accused person have been granted bail vide order dated 06.05.2025 passed in Cr.Misc. No. 27275 of 2025.
5. Learned APP opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-VIII, Samastipur dated 25.03.2025, it appears that petitioner is named in the FIR. From perusal of the records, it appears that on the basis of written report of the informant Rajesh Choudhary, FIR has been lodged under Sections 115(2), 118(1), 117(2), 126(2), 109, 303(2), 3(5) of the BNSS against seven accused persons including the present petitioner. It also appears that four co-accused persons have already been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 12560 of 2025 vide order dated 25.03.2025, the case of the petitioner is also identical to this case, so considering all these aspects of the case and submission of learned counsel for the petitioner, I am inclined to
Patna High Court CR. MISC. No.28252 of 2025(2) dt.07-05-2025 3/3 grant bail to the petitioner.
7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Rosera / Successor Court in connection with Hasanpur P.S. Case No. 135 of 2024.
