2. The petitioner has prayed for bail in connection with Chakmehsi P.S. Case No. 10 of 2025 registered for the offence punishable under sections 309(4) of Bhartiya Nayay Sanhita, 2023.
3. As per allegation in the FIR, four accused persons riding on two motorcycles intercepted the informant and looted an amount of Rs. 75,480/- and mobile on knife point and fled away.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. Petitioner is not named in the FIR. His name surfaced in this case on the basis of confessional statement
Patna High Court CR. MISC. No.23322 of 2025(2) dt.28-04-2025 2/2 of apprehended accused Abshiek Kumar and Nitin Kumar before the police. Save and except confessional statement, nothing has come against the petitioner in the present case. Till date no TIP has been done. After completion of investigation, police has submitted charge-sheet against the petitioner. Petitioner has got no criminal antecedent and he is languishing in judicial custody since 31.01.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned JMFC-cum-Additional Munsif, Samastipur in connection with Chakmehsi P.S. Case No. 10 of 2025.
