The petitioners apprehend their arrest in Khaira P.S. Case No. 181/2016, registered for the offences punishable under Section 302 and other sections of the Indian Penal Code. The informant alleged that while he was sleeping with his brother, he saw the accused persons dragging his brother Nagendra Mahto. The informant informed other members of the family. He saw that the accused persons including the petitioners caught his brother and strangulated him to death. Learned counsel for the petitioners submits that the petitioner no. 2 is unmarried girl. No specific allegation is made against the petitioners, but it appears that the informant saw that

Patna High Court Cr.Misc. No.17570 of 2017 (4) dt.06-07-2017 2/2 the petitioners were also holding the legs of the deceased Nagendra Mahto. Nagendra Mahto was strangulated to death. Considering the facts aforesaid, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected.
