This is an application seeking quashing of the FIR of Gandhi Maidan P.S. Case No. 138 of 2016 dated 20.04.2016 instituted for the offences under Sections 166, 167, 420, 421, 466, 467, 468 and 120(B) of the Indian Penal Code.

On 15.09.2020, this Court had called for a report about the stage of the case. The report which has been received indicates that the case is still pending awaiting the submission of final form/charge sheet. Since this is a case of the year 2016, the investigation ought to have been completed by now. If the same has not been completed, the same should be

Patna High Court CR. MISC. No.31485 of 2016(3) dt.05-11-2020 2/2 concluded preferably within a period of three months and a report be submitted before the court below. In case the petitioner would feel aggrieved by the report of the police or any order passed by the court on such report, he would have the liberty to avail of the remedies to which he is entitled under the appropriate forum.

The petition stands disposed of accordingly.
