The petitioner apprehends his arrest in Sherghati (Dobhi) P.S. Case No. 14/2017, registered for the offences punishable under Sections 413, 414, 420, 384, 467, 468, 471, 120(B) of the Indian Penal Code and sections 33 and 34 of the Forest Act.
The informant S.H.O. of Dobhi P.S. raided the Check Post and apprehended Putu Kumar, Jayram Kumar and Rakesh Kumar. The driver of truck no. BR02Q/8661 and BR01GD/6891 disclosed that the petitioner and others got the trucks pass through the Check Post on the basis of forged documents. Learned counsel for the petitioner submits that there is no material to show that the petitioner is involved in the racket.
Patna High Court Cr.Misc. No.17521 of 2017 (4) dt.06-07-2017 2/2 Nothing has been recovered from the possession of the petitioner. Learned A.P.P. however, opposed the prayer for anticipatory bail of the petitioner.
It appears that of course, the petitioner is named in the F.I.R., but no document has been recovered from the possession of the petitioner to show that the petitioner got the truck pass through the Check Post on the basis of forged documents.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 14/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
