JUSTICE RAVI RANJAN ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

It is contended that altogether 360 boxes of Sanitary Napkin were received by the petitioner, out of which, he has already distributed 230 boxes of Sanitary Napkin. Only 130 boxes of Sanitary Napkin still remains with him which he undertakes to return.

Having regard to the facts and circumstances of the case, if the petitioner returns the napkin, then let the petitioner, namely, Prabhat Kumar Madhukar, be released on bail in the event of his arrest/surrender before the court below within a period of

Patna High Court Cr.Misc. No.31139 of 2016 (2) dt.08-08-2016 2/2 eight weeks from today in connection with Hayaghat P.S. Case No. 22 of 2015 on furnishing bail bond of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.

Further, it is made clear that at the time of furnishing bail bonds, the petitioner will have to produce the receipt granted by the competent authority that he has already returned 130 boxes of Sanitary Napkins.
