====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------------- 14-10-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Forest Case No.35 of 2012 registered under Section 33(C) of the Indian Forest Act besides Section 2 of the Forest Protection Act. The accusation is of loading the stone on tractor at the forest by the petitioners on 03.07.2010, which was protested by the officials of the forest.

Learned counsel appearing on behalf of the petitioners submits that the petitioners have falsely been implicated in this

Patna High Court Cr.Misc. No.43426 of 2015 (2) dt.14-10-2015 2/2 case on mere suspicion as it would appear from the prosecution report itself that the petitioners have not been arrested at the spot by the forest officials. It is also submitted that the petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Aurangabad, namely, Sri Sanjeev Kumar, in connection with Forest Case No.35 of 2012, subject to the conditions laid down under Section 438(2) Cr.P.C.
